📜 Agreement to Terms

By downloading, accessing, or using Artoli 3D (the “Application”), developed by Braitoli (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”) and Apple’s Standard Licensed Application End User License Agreement (Apple Standard EULA). If you do not agree to these Terms, do not install or use the Application.

1. License Grant and Scope of Use

Braitoli grants you a limited, non-exclusive, non-transferable, revocable license to install and run Artoli 3D on Apple-branded devices (iPhone, iPad) that you own or control, strictly for personal, non-commercial, and educational creative entertainment.

• You may not reverse engineer, decompile, disassemble, or extract source code from the Application.
• You may not modify, rent, lease, loan, sell, distribute, or create derivative works based on the Application or its underlying 3D assets without explicit written authorization.

2. Intellectual Property Rights

All intellectual property rights in and to the Application—including but not limited to 3D meshes, procedural geometry, textures, color quantization shaders, audio soundscapes, tactile haptic patterns, user interfaces, branding, and logos—are the sole and exclusive property of Braitoli or its respective licensors.

Your Artworks: You retain ownership of the unique creative painted arrangements and final image exports produced by your artistic interaction with the 3D models. You are free to share your exported images for personal, non-commercial use.

3. In-App Purchases, Virtual Currency (Stars), and Unlocks

Artoli 3D offers optional in-app digital items processed exclusively through Apple StoreKit:

• Virtual Stars (Consumable Packs): Star packs (e.g., 50, 200, 500, 1000, 2000, 5000 Stars) constitute a limited, non-transferable, revocable license to unlock digital 3D statue presets within the Application. Stars possess no real-world monetary value, cannot be exchanged for fiat currency, and cannot be transferred between accounts or outside the Application.
• Statue Unlocks: Once a statue is unlocked with Stars, it remains permanently accessible to your Apple ID across authorized devices. Starter Level 1 statues remain permanently free.
• “Unlock All” Pass (Non-Consumable): Purchasing the lifetime Unlock All tier permanently unlocks all current statue models in the library, as well as future statue releases.
• Subscriptions (Studio Pass): If you choose an auto-renewing subscription (e.g., Monthly Pass or Annual VIP), payment is charged to your Apple Account upon confirmation. Subscriptions automatically renew unless auto-renew is cancelled at least 24 hours prior to the end of the current billing cycle. You may manage or cancel subscriptions anytime in your Apple ID Account Settings.
• Refunds: All payments and refund requests are governed by Apple's standard App Store purchase terms. Braitoli cannot directly issue refunds for transactions completed through Apple StoreKit.

4. User-Generated Content & Custom 3D Model Imports (UGC Disclaimer)

The Application includes a local file import feature enabling users to load external 3D files (.glb, .gltf, .obj) for personal painting:

• All imported 3D models are processed locally on your device hardware; Braitoli does not preview, host, or store imported files on any server.
• You represent and warrant that you hold all necessary legal rights, licenses, and permissions for any third-party 3D model you import.
• You agree not to import any files that contain infringing material, defamatory content, malicious code, or sexually explicit content.
• Disclaimer: Braitoli disclaims any and all liability arising from copyright infringement, data corruption, or damages resulting from files imported by users.

5. Privacy and Children's Safety

Your privacy is of paramount importance. Our data practices are detailed in our Privacy Policy. Artoli 3D complies with COPPA and GDPR, operates in an offline-first architecture, and does not collect or monetize personal identities or children's information.

6. Disclaimer of Warranties (“AS IS”)

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BRAITOLI DOES NOT WARRANT THAT THE APPLICATION WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPATIBLE WITH ALL HARDWARE CONFIGURATIONS.

7. Limitation of Liability

IN NO EVENT SHALL BRAITOLI, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF DATA, DEVICE DAMAGE, OR INTERRUPTION OF CREATIVE WORK) ARISING OUT OF OR RELATING TO YOUR USE OR INABILITY TO USE THE APPLICATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Governing Law and Severability

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Braitoli operates, without regard to its conflict of law principles. If any provision of these Terms is found to be unlawful or unenforceable, that provision will be deemed severable and will not affect the validity and enforceability of any remaining provisions.
